Job Description: Investigator

SIU Investigators are the front line of the Unit, its "face" in the community. Investigations must be carried out in a credible, fair and balanced manner. Successful candidates will possess good judgement, honesty, integrity and strong ethical values. Duties & Responsibilities

Conducts objective, fair, thorough, unbiased and timely investigations into matters within the jurisdiction of the SIU as provided for in Section 113 of the Police Services Act and Ontario Regulation 267/10 by:

  • Receiving assignment and direction from Senior SIU Staff to conduct investigations;
  • Assessing the scope and determining the methodology needed to carry out an efficient investigation, including the need to evaluate the demand for specialized assistance and support e.g. identification or other forensic services and generally determining what evidence is required and who should be interviewed;
  • Coordinating the list of people to be interviewed and interviewing both police and civilian witnesses to, or participate in, the incident being investigated;
  • Gathering and analyzing evidence in accordance with the prescribed rules of evidence and the law with respect to recognized investigative procedures and as directed by the Operations Policies of the Special Investigations Unit;
  • Preparing comprehensive reports of investigations and, as may be required, to make recommendations regarding action to be taken regarding the investigation. As required or directed provide assistance to the Crown Attorneys Office in the preparation of cases where charges are laid by:
  • Obtaining additional evidence as may be required to support the charge in question;
  • preparing Crown Briefs for presentation before the court
  • providing all information obtained during the investigation the Crown Attorney considers relevant to the charge.
  • Appearing as a witness and giving evidence during trials, Coroner's Inquests or any other form of hearing;
  • Attending courses, seminars and related training sessions related to the Administrative and Operational duties of the Special Investigations Unit.
  • Demonstrating an understanding for the need to be sympathetic, tolerant, patient and sensitive to the needs of all persons involved in the investigative process and to the public and its communities given the genesis of the Special Investigations Unit.
  • Using tact, discretion and honesty when gathering, discussing and disclosing case related information and evidence.
  • Other duties as assigned.
  • Must have valid Class 'G' driver's licence

Knowledge

  • thorough knowledge of specialized investigative techniques, procedures, legislation and courtroom procedures to carry major/involved investigations by gathering and interpreting evidence and making recommendations for follow-up (e.g. criminal charges); and to provide group leadership to field staff by providing expertise, on the job training, guidance and direction at scenes.
  • thorough knowledge of a body of regulations, statutes and related significant precedents (i.e. a sound knowledge and understanding of relevant Constitutional Law, the Criminal Code of Canada, the Canada Evidence Act, the Coroner's Act, the Police Services Act of Ontario and the Regulation and policies governing the response of the Special Investigations Unit) to both gather/interpret evidence during investigations and provide guidance to field staff in same by ensuring continuity of evidence, identifying/explaining evidence required to support tests/theories of cases, ensuring quality and compliance of investigations;
  • knowledge of basic theories to gather evidence and interpret findings by examining scenes, identifying potential tests for proving theories, identifying need for special services and providing testimony in court, at inquests;
  • knowledge of supervisory and group leadership techniques, to provide expertise and direction to field staff, identify training requirements for manager; and to lead a multi-faceted team during an investigation by directing personnel, co-ordinating work and integrating of findings.

Skills

  • analytical and reasoning skills to conduct special investigations (e.g. those involving significant public/police interest issues), assessing and interpreting evidence, maintaining the integrity of the investigative file, evaluating investigative results and determining cause; analysing the circumstances and making recommendations to the Director with respect to the decision to lay or not to lay a charge against a police officer;
  • evaluative skills to identify and assess trends and patterns requiring further investigation;
  • analytical skills to assess guidance required by field staff, assign work to meet priorities and operational requirements;
  • communication skills to: explain and discuss interpretations of evidence, and related legislation, policies, procedures and guidelines, and theories about the investigation; using appropriate judgment in communicating confidential and sensitive information, and providing testimony in court or at coroners inquests; serving as the Unit's on-scene media spokesperson for those incidents that have gained immediate media attention;
  • presentation skills to deliver lectures, seminars and attend meetings and writing skills to prepare training materials, Crown Briefs, reports;
  • interpersonal skills to persuade and ensure compliance with established methods, models and concepts of investigation, to discussion among agencies involved in an investigation (police, ambulance, Coroner) and reconcile differing interpretation of evidence, views of appropriate follow-up to investigation;
  • group leadership skills to assign and coordinate work of field investigators, including on the job guidance.

Freedom of Action

Work is carried out within overall framework of ministry and SIU procedural controls and operational plans and within a body of legislation/regulations, standards and precedents related to the investigation of police, e.g. the Criminal Code of Canada, the Canada Evidence Act, the Coroner's Act, the Police Services Act of Ontario and the Regulation and Orders governing the response of the Special Investigations Unit. Work requires exercising considerable latitude in:
  • determining work assignments of field staff, setting priorities and providing on the job guidance and direction in the conduct of investigations; coordinating scene and providing technical direction/support to field investigator when fatalities are involved;
  • determining relevance of evidence and direction of investigation for major/involved occurrences, including tests/theories to support interpretation;
  • making recommendations for changes to regulations, standards based on investigation findings and in recommending additional investigation based on analysis.
Work is reviewed by manager for quality of investigations carried out and adherence to operational plan. Work requires referring to manager matters that deviate from policy, have a province wide impact, involve expenditure of resources.
