Acting Director: Nothing Hamilton Motorcycle Officer Did or Failed to Do in Collision with another Motorcycle that would Justify Criminal Proceedings

The Acting Director of the Special Investigations Unit, Joseph Martino, has found that a Hamilton Police Service motorcycle officer that was involved in a collision with another motorcyclist did nothing that would justify criminal proceedings against him.  The collision and subsequent arrest happened in September 2016, just west of Upper James Street in Hamilton. 
The Director’s Report was delivered to the Attorney General, as is required by law under the Police Services Act. The Attorney General has directed that the document be posted online. It can be found at

The SIU is an arm’s length agency that investigates reports involving police where there has been death, serious injury or allegations of sexual assault. Under the Police Services Act, the Director of the SIU must

  • consider whether an officer has committed a criminal offence  in connection with the incident under investigation
  • depending on the evidence, lay a criminal charge against the officer if appropriate or close the file without any charges being laid
  • report the results of any investigations to the Attorney General.
