SIU Updates Investigation into Shooting Death in Port Credit

On September 18, 2005, an Ontario Provincial Police (OPP) officer arrested Mr. Maltar on Highway 403 for a traffic violation and brought him to the Port Credit detachment. The officer was attempting to lodge Mr. Maltar into a holding cell and became involved in a struggle with him, resulting in shots being fired from a police firearm.
A post mortem examination determined Mr. Maltar died from a gunshot wound to his head.
The SIU has designated two subject and four witness officers as part of the probe. The involved officers' firearms, duty belts and clothing have been seized for forensic testing.
The SIU is an arm’s length agency that investigates reports involving police where there has been death, serious injury or allegations of sexual assault. Under the Police Services Act, the Director of the SIU must
- consider whether an officer has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, lay a criminal charge against the officer if appropriate or close the file without any charges being laid
- report the results of any investigations to the Attorney General.
