L’UES conclut que la poursuite d’un véhicule à St. Catharines et l’arrestation subséquente du conducteur avec l’aide d’un chien policier étaient licites – aucun motif d’accusation

Le 16 novembre 2017, le Service de police régional de Niagara (SPRN) enquêtait sur un homme suspecté d’avoir commis une série de vols qualifiés dans la région de St. Catharines. Des agents ont tenté en vain d’intercepter le véhicule que conduisait l’homme et ont engagé une poursuite. Peu après, le véhicule de l’homme est entré en collision avec un autre véhicule. L’homme a poursuivi sa route, mais lorsque son véhicule est finalement tombé en panne, il est sorti et a tenté de s’enfuir à pied. Avec l’aide d’un chien policier, l’homme a été appréhendé. Le directeur de l’Unité des enquêtes spéciales, Tony Loparco, a conclu qu’il n’y avait aucun motif raisonnable de déposer des accusations criminelles contre un agent du SPRN dans cette affaire.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must
- consider whether the official has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
- publicly report the results of its investigations
