SIU Investigating Incident in Brant County

TORONTO (2 May, 2008) --- The Special Investigations Unit (SIU) has concluded its investigation into the injuries suffered by a motorcyclist in Brant County on April 6, 2008.

The SIU assigned four investigators and two forensic investigators to probe the circumstances of this incident.

The SIU investigation determined that at 3:20 p.m. April 6, 2008, an Ontario Provincial Police (OPP) officer was stationary on Highway 403 operating radar. An eastbound motorcycle passed the officer at a high rate of speed.

A short time later the OPP was called to Middleton Line Road north of Highway 403 in regards to an accident involving a motorcycle. It was determined that this motorcyclist was the same one that had sped by the OPP officer moments earlier on Highway 403. The 38-year-old driver of the motorcycle sustained a fracture. He was transported to Woodstock General Hospital by ambulance where he was treated and later released.

The Deputy Director of the SIU, Ian Scott, concluded that, "There are no reasonable grounds to believe the OPP officer committed any criminal offence with respect to this incident. There is simply no nexus between the injuries received by the motorcyclist and the actions of the OPP officer."

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
