SIU Terminates Oshawa Investigation Due to No Serious Injury Sustained

Mississauga (Ontario) (4 July, 2019) ---
Le directeur intérimaire de l’Unité des enquêtes spéciales, Joseph Martino, a mis fin à l’enquête sur l’arrestation d’un homme de 35 ans survenue en avril 2019 à Oshawa.

Dans la nuit du 6 avril 2019, des agents du Service de police régional de Durham ont arrêté un homme dans le secteur de la rue Athol Est et de la rue Drew, à Oshawa. Ils l’ont conduit au poste de police où il a été placé dans une cellule. Il a été relâché le lendemain. Quelques jours plus tard, l’homme s’est rendu à un centre médical pour le traitement de blessures.

Le directeur intérimaire, Joseph Martino, a déclaré : « D’après les enquêtes préliminaires de l’UES, qui comprenaient un examen du dossier médical de l’homme, il est évident que ce dernier n’a subi aucune fracture au cours de ses interactions avec les agents de police le 6 avril 2019. En conséquence, en l’absence de “blessure grave”, l’UES n’a pas compétence pour poursuivre son enquête, et le dossier est clos. »

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
