No Basis to Lay Charges in Relation to Arrest of Man in Erin

Mississauga, ON (10 October, 2019) ---
On November 18, 2018, a 43-year-old man was lodged in a police cell, having been arrested for public intoxication. The following day, the man complained of pain and was subsequently taken to hospital where he was diagnosed with broken ribs. The Interim Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to lay criminal charges against any police officer in relation to this incident.

The SIU is a civilian agency that investigates reports involving police where there has been death, serious injury or an allegation of sexual assault. Under the Police Services Act, the Director of the SIU must

  • consider whether an officer has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, lay a criminal charge against the officer if appropriate or close the file without any charges being laid
  • report the results of investigations to the Attorney General.
