Aucun motif raisonnable de porter des accusations contre un agent de police relativement à une arrestation de Welland

Le 18 février 2019, des agents de la Police régionale de Niagara ont été envoyés à une résidence, à Welland, en réponse à un appel pour querelle domestique. Une confrontation s’est ensuivie entre un agent et un homme de 64 ans. Lorsque l’homme a tenté de mordre l’agent, celui-ci a réagi en lui donnant deux coups de coude à la tête. D’autres agents sont arrivés et ont placé l’homme en état d’arrestation. L’homme a alors été conduit à l’hôpital où on lui a diagnostiqué de multiples fractures et un poumon collabé. Le directeur intérimaire de l’Unité des enquêtes spéciales, Joseph Martino, a conclu qu’il n’y avait aucun motif raisonnable de porter des accusations criminelles dans cette affaire.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
