No Charges to Issue in Relation to Police-Involved Shooting in Toronto Restaurant Drive-thru

Mississauga, ON (16 April, 2020) ---
The Director of the Special Investigations Unit, Joseph Martino, has determined that there are no reasonable grounds to lay criminal charges against a Toronto Police Service officer in relation to a police-involved shooting that occurred in the area of Jane Street and Falstaff Avenue in October of 2019. As a result of the shooting, a 29-year-old man was treated at hospital for gunshot wounds to his right shoulder blade, his right forearm, and his left thigh.

The SIU is a civilian agency that investigates reports involving police where there has been death, serious injury or an allegation of sexual assault. Under the Police Services Act, the Director of the SIU must

  • consider whether an officer has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, lay a criminal charge against the officer if appropriate or close the file without any charges being laid
  • report the results of investigations to the Attorney General.
