No Basis to Proceed with Charges in Peterborough Fatal Police-Involved Shooting and Pursuit that Preceded Collision

Mississauga, ON (29 June, 2020) ---
On July 23, 2019, following a BOLO (be on the lookout) for a stolen red Mustang, a Peterborough Police Service officer located the vehicle and initiated a vehicular pursuit. The pursuit ended when the Mustang became involved in a collision with another motor vehicle. As a result of the collision, a 64-year-old woman from the second vehicle sustained a broken arm. After a stand-off with police, the driver of the stolen motor vehicle was shot and killed by an officer. The Director of the Special Investigations Unit, Joseph Martino, has determined there is no basis for proceeding with criminal charges in this case, and the file is closed.

The SIU is an arm’s length agency that investigates reports involving police where there has been death, serious injury or allegations of sexual assault. Under the Police Services Act, the Director of the SIU must

  • consider whether an officer has committed a criminal offence  in connection with the incident under investigation
  • depending on the evidence, lay a criminal charge against the officer if appropriate or close the file without any charges being laid
  • report the results of any investigations to the Attorney General.
