SIU Concludes Investigation into Man’s Broken Ankle in Sudbury

Mississauga, ON (16 November, 2023) ---
The Director of the Special Investigations Unit, Joseph Martino, found no reasonable grounds to believe a Greater Sudbury Police Service officer committed a criminal offence in connection with the arrest and serious injury suffered by a 28-year-old man.

On July 18, 2023, officers went to a residence in the area of Sunrise Ridge Drive and Mont Adam Street after receiving a 911 call about a disturbance between the man and his mother. The man was also found to be subject to several arrest warrants. As the mother, who appeared distressed, opened the door for police, the man fled through a backdoor. Officers chased after the man. An officer arrested the man. While in the booking hall, the man was taken down after he shoved an officer. While the man was prone on the floor, the officer dropped his lower right leg onto the man’s lower left leg. Following complaints of pain in his left leg, the man was taken to hospital and diagnosed with a broken ankle.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
