SIU Terminates Investigation into Man’s Injury in Fall While Evading Police in Sudbury

The Deputy Director of the Special Investigations Unit, Stacey O’Brien, has terminated an investigation into serious injuries suffered by a 32-year-old man in Sudbury.
On May 29, 2025, Greater Sudbury Police Service Emergency Response Unit officers executed a search warrant at an apartment in the area of Elgin and Elm Streets. Officers gained entry to the unit through an unlocked door. A distraction device was deployed, officers announced their presence, and stated the purpose of their attendance. When police entered, the man exited the unit through the fourth-storey window and landed on the rooftop of a second-storey building. The man was located and arrested. During his arrest he complained of pain to his left side and was transported to hospital, where he was diagnosed with fluid accumulation in the kidney and liver area. The man had no interaction with police prior to his decision to depart the premises via the fourth-floor window.
Based on the SIU’s preliminary inquiries, corroborated by video footage, police were not responsible for the injuries sustained by the man. In conclusion, there being patently nothing to investigate as far as the potential criminal liability of the police is concerned, the file has been closed.
The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must
- consider whether the official has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
- publicly report the results of its investigations
