SIU Concludes Investigation into Kitchener Highway Shooting

Mississauga, ON (24 October, 2025) ---
On November 29, 2024, a man jumped out of a pick-up truck in motion following an argument between occupants of the vehicle. After exiting the pick-up, the man got back into the vehicle. OPP officers were notified of this, and they were dispatched to locate the vehicle. The pick-up truck was located as it travelled eastbound on Highway 401 towards Kitchener. Based on the circumstances, the decision was made to execute a “high-risk takedown”. Two officers brought their vehicles to a stop at an angle in front of the driver and passenger side front corners of the pick-up truck, while two other officers positioned their cruisers behind the truck. The officers in front exited their vehicles with their guns drawn. One of these officers discharged his firearm in the direction of the male driver. Following the shooting, the pick-up truck’s occupants were removed from the vehicle. The 46-year-old driver was transported to hospital and treated for a gunshot wound to his right arm. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that the officer committed a criminal offence in connection with the shooting.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
