SIU Concludes Investigation into Scarborough Arrest

Mississauga, ON (5 December, 2025) ---
In the afternoon of August 15, 2025, store security from an LCBO contacted the Toronto Police Service to report the theft of alcohol by a male. Upon arriving in the area of Eglinton Avenue East and Brimley Road, officers located a man fitting the description of the suspect standing at the bottom of a stairwell to a basement apartment. The officers told the man he was under arrest and directed him to come up to ground-level. The man climbed up a few steps and then started to protest that “it wasn’t me”.  The officers continued to order the man up and then took hold of him when he refused to comply. A struggle ensued. With the aid of additional officers who had arrived on scene, the man was arrested. At hospital, he was diagnosed with rhabdomyolysis. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any officer committed a criminal offence in connection with the 39-year-old man’s arrest and injury.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
