SIU Discontinues Investigation into Pickering Collision

The Deputy Director of the Special Investigations Unit, Stacey O’Brien, has terminated an investigation into a collision that occurred in April in Pickering.

In the morning of April 26, 2026, two Durham Regional Police Service officers were engaged in traffic control duties on Highway 401, in Pickering, in relation to a fatal motor vehicle collision being investigated by the OPP. The officers were parked in a fully marked police vehicle across the eastbound collector express and centre lanes at Brock Road, with emergency lights activated. The police vehicle was accompanied by two crash trucks, also operating with emergency lights activated. A row of reflective pylon cones was arranged behind the vehicles. The police and crash vehicles were positioned to direct motorists towards the Brock Road exit. While travelling eastbound in the express lane, a motorist continued past the line of pylon cones, through the traffic diversion measures, and struck the rear of the parked police vehicle. The 50-year-old male driver was taken to hospital and reportedly diagnosed with a fractured sternum.  

Based on the SIU’s preliminary inquiries, including video footage that captured the incident, Deputy Director O’Brien was satisfied that the investigation should be discontinued. The video evidence suggested that the officers did not contribute to the collision. Additionally, efforts by the SIU to speak with the man since the incident were unsuccessful. In the absence of a statement, or confirmation of ‘serious injury’ within the mandate of the SIU, there was an insufficient evidentiary foundation from which to proceed with an investigation. As such, the file has been closed.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
