SIU Concludes Investigation into Man’s Injuries After Windsor Officer’s CEW Discharge

Mississauga, ON (8 September, 2026) ---
The Director of the Special Investigations Unit, Joseph Martino, found no reasonable grounds to believe a Windsor Police Service officer committed a criminal offence in connection with the facial fractures suffered by a 33-year-old man. 

On May 25, 2026, officers were called about a man who had reportedly assaulted a woman at Pitt Street and Ouellette Avenue in Windsor. The man fled after the officer arrived at the scene. While pursuing the man, the officer discharged his conducted energy weapon (CEW) causing the man to fall forward and strike his face on the sidewalk. He was arrested and taken to hospital where he was treated for fractures of the right orbital bone.

Director Martino was satisfied the use of the CEW made sense to temporarily incapacitate the man to arrest him as the man had continued to run despite being told to stop.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
