SIU Terminates Investigation into Man’s Broken Foot in Flight from York Police

Case Number: 26-OCI-286

Mississauga, ON (14 October, 2026) ---
The Deputy Director of the Special Investigations Unit, Stacey O’Brien, has terminated an investigation into a 34-year-old man who was seriously injured while fleeing York Regional Police in Scarborough.

On June 17, 2026, officers from York Regional Police’s Auto Cargo Unit saw a stolen Jeep Grand Cherokee with a smashed rear window in the vicinity of Old Kingston Road in Scarborough. Officers maintained surveillance and utilized the air unit as the driver of the SUV travelled throughout the city. The driver later entered the Walmart parking garage at Scarborough Town Centre, where its occupants, including the man, exited and fled on foot. During the ensuing foot pursuit, the man went over a ledge in the parking structure and fell approximately 20 to 30 feet. He was subsequently arrested and transported to the hospital, where he was diagnosed with a heel and ankle fracture.

As depicted in the video evidence, the man went over the ledge while attempting to flee from police. There was no evidence of any physical contact between the man and police before he went over the ledge. The evidence indicates that the fractures were sustained when the man struck the ground following the fall. On this record, it is plain and obvious that the police did nothing that could conceivably attract criminal liability in connection with the man’s injuries. Accordingly, there being patently nothing to investigate as far as the potential criminal liability of the police is concerned, the file has been closed.

All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
