No Charges Warranted in Toronto Death Case

Mississauga (18 November, 2015) ---
Ontario's Special Investigations Unit is probing the circumstances surrounding the death of a 43-year-old man in Toronto. 

Preliminary information suggests the following:
  • On November 6, 2015, a few minutes after midnight, a 911 call was made;
  • Toronto Police attended an apartment at 10 Dora Avenue, in the Bloor Street West and Lansdowne Avenue area;
  • Inside the apartment, officers encountered a man;
  • Emergency Task Force officers were called for assistance;
  • During the interaction with the man, two conducted energy weapons (CEWs) were deployed; 
  • The man was transported to St. Joseph's Health Centre;  
  • On November 7, 2015, the man was pronounced dead.

The SIU has assigned three investigators and one forensic investigator to probe the circumstances of this incident.

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
