Due to Man’s Lack of Cooperation, SIU Terminates Sudbury Investigation

The Director of the Special Investigations Unit, Tony Loparco, has terminated an investigation into an incident that occurred last month in Sudbury involving a 25-year-old man and Greater Sudbury Police Service officers.

On September 23, 2018, Greater Sudbury Police Service officers attended a multi-unit dwelling on College Street, north of Frood Road, for a wanted individual. An officer observed the wanted individual, and the 25-year-old man, at a second-floor window. At the request of the officer, the wanted individual surrendered himself. The 25-year-old man – who was not wanted – then jumped from the window to the pavement below. When he complained of pain, he was taken to hospital for treatment.

SIU investigators made numerous phone calls to the man and left voice messages. But these messages, and a text message, were not returned. Investigators also attended various addresses he was associated with, but this was to no avail. 

Director Loparco said, “The man has declined to provide a statement to the SIU or otherwise participate in the investigation. Accordingly, I have terminated the investigation into this incident.”

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
