SIU Concludes Investigation into Man’s Hip Broken During Brampton Arrest

The Director of the Special Investigations Unit, Joseph Martino, found no reasonable grounds to believe a Peel Regional Police Service officer committed a criminal offence in connection with a 42-year-old man’s fractured right hip. On June 17, 2024, officers were dispatched to a residence in the area of Dixie Road and Queen Street East in Brampton. The man reportedly assaulted the 911 caller’s mother.
The man fled and hid in a nearby park. Officers located the man hiding underneath a tree and he ran. The man was tackled from behind by an officer. The man complained of pain in his leg, was handcuffed and taken to an ambulance. He was diagnosed with the injury at hospital.
Director Martino concluded that when the man refused to get down at the direction of the officer and instead started to run away, the subject official was entitled to resort to a measure of force to thwart the escape.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must
- consider whether the official has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
- publicly report the results of its investigations
