SIU Concludes Investigation into Man Seriously Injured in Fall from Toronto Apartment Window

The Special Investigations Unit found no reasonable grounds to believe a Toronto Police Service officer committed a criminal offence in connection with a 58-year-old man seriously injured in a fall from his apartment. The SIU investigated as at the time officers were outside his door attempting to negotiate his arrest.
On July 19, 2024, officers went to the man’s apartment as they had information to believe he assaulted a woman. To no avail, the officers attempted to persuade the man to exit his apartment. The police were outside his door for about 30 minutes while they tried to get a warrant to enter when the man jumped out his window. He suffered fractures to his spine, legs, pelvis and ribs.
Director Joseph Martino concluded it was apparent that none of the officers transgressed the limits of care prescribed by the criminal law.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must
- consider whether the official has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
- publicly report the results of its investigations
