SIU Concludes Investigation into Man’s Collarbone Broken During Arrest in Sudbury

Mississauga, ON (12 November, 2024) ---
The Special Investigations Unit found no reasonable grounds to believe two Greater Sudbury Police Service officers committed a criminal offence in connection with the serious injury of a 46-year-old man. On July 15, 2024, police were called to an apartment at Bruce Avenue and Cambrian Heights Drive after a man believed to be on drugs had thrown a sink and sofa off a balcony. The man also had warrants for his arrest.

While attempting to flee, an officer tackled the man in a corridor. The man resisted as officers tried to bring his arms behind his back while he was on the floor.

Director Joseph Martino concluded the tackle made sense as some form of physical intervention was necessary to take the man into custody. He found the tackle accomplished this without the use of any weapons.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
