Man’s Fractured Heel a Result of Jumping from Home’s Window in Cornwall; SIU Terminates Investigation

The Director of the Special Investigations Unit, Joseph Martino, has terminated an investigation into the circumstances surrounding the serious injury suffered by a 23-year-old man last month in Cornwall.

In the evening of March 11, 2022, a Cornwall Police Service officer attended a residence on McConnell Avenue to arrest a man in relation to several outstanding warrants. When the officer was let in by another occupant of the home, the man of interest jumped from a second-floor window and fled. The man managed to make it a short distance before he was located by the officer and taken into custody without incident. The man was taken to hospital where he was diagnosed with a heel fracture. 

Director Martino concluded that the officer was not in the same room as the man when he ill-advisedly jumped from the window. In the circumstances, as it was plain and obvious that the officer did nothing to cause or contribute to the man’s injury by way of any criminal conduct, the file has been closed.      

The SIU is an independent government agency that investigates the conduct of officials (police officers as well as special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
