No Basis to Criminally Charge Any Officer in Relation to Schomberg Arrest

On April 15, 2025, two individuals were in a stolen Jeep SUV when they were confronted by unmarked police vehicles in the driveway of a rural property in Schomberg. The unmarked police vehicles were occupied by members of the York Regional Police Auto Cargo Theft Unit. Stopped with police vehicles in front of and behind the Jeep, both vehicle occupants exited and began to flee. An officer caught up to the driver, a 34-year-old man, and tackled him to the ground. Following a struggle, the man was arrested. At hospital, he was diagnosed with a fractured left orbital bone. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that any officer committed a criminal offence in connection with the man’s arrest and injury.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must
- consider whether the official has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
- publicly report the results of its investigations
