SIU Terminates Investigation into Man’s Injuries Following Motorcycle Crash in Hamilton

The Director of the Special Investigations Unit, Joseph Martino, has terminated an investigation into injuries suffered by a 39-year-old man in a motorcycle crash in Hamilton.
Based on the SIU’s preliminary inquiries, including an interview with the man, Director Martino was satisfied the investigation should be discontinued at this time. The man was arrested in the early afternoon of March 12, 2025, following a motorcycle crash in which police rendered assistance at Upper Wentworth Street and Stone Church Road East. While aiding the man, police discovered an outstanding warrant and arrested him. The man complained of arm and leg pain, and was transported to hospital, where he was diagnosed with a fractured left elbow and a fractured left knee. The man was fleeing his girlfriend’s residence on a motorcycle and fell. The man had no interaction with police at the time and acknowledged that no force was used against him during his interaction with police. The motorcycle collision resulted in his fractures. On this record, it was apparent that the man alone was responsible for his injury.
The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must
- consider whether the official has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
- publicly report the results of its investigations
