SIU Terminates Investigation into Man’s Fractures After Man Fled Police in Oakville

The Deputy Director of the Special Investigations Unit, Stacey O’Brien, has terminated an investigation into the serious injuries suffered by a 36-year-old man in Oakville.

Preliminary information suggests in the evening of May 16, 2025, Halton Regional Police Service officers were dispatched to a domestic disturbance call at an apartment on Old Bronte Road. Officers knocked, and the man, who was on probation, fled arrest by jumping from the balcony to the ground and ran through nearby backyards. Eventually the man flagged down a passing ambulance which transported him to the hospital. He was diagnosed with multiple fractures, including injuries to both feet, the left ankle, right arm, right lower leg, right second toe, and left orbital bone. 

Deputy Director O’Brien found the evidence indicated the man had no interaction with police at the time of his descent from the balcony and the impact with the ground was the sole contributor to his injuries.  

On this record, it was plain and obvious that the police did nothing that could conceivably attract criminal liability in connection with the man’s injuries. Accordingly, there being patently nothing to investigate as far as the potential criminal liability of the police is concerned, the file has been closed.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
