SIU Concludes Investigation into Oakville Arrest

In the early morning of May 13, 2025, Halton Regional Police Service officers were dispatched to a residence in Oakville to investigate an assault call. From an open door, the officers called-out to a 26-year-old male person of interest and directed him to surrender. The man approached the top of a staircase. He raised his hands and started to walk down the stairs. He talked about wanting the officers to shoot him and, midway down the stairs, stalled his progress. Shortly after, he resumed his downward movement and was tasered by an officer. The man stumbled and was pinned by another officer with the use of his shield. Another officer engaged the man physically and punched him twice in the head. The man was subsequently arrested. At hospital, he was diagnosed with left-sided facial fractures. On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that the officer committed a criminal offence in connection with the man’s arrest and injuries.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must
- consider whether the official has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
- publicly report the results of its investigations
