SIU Discontinues Hamilton Investigation

The Deputy Director of the Special Investigations Unit, Stacey O’Brien, has terminated an investigation into the serious injuries suffered by a woman in August in Hamilton.

In the evening of August 24, 2025, a Hamilton Police Service officer was conducting speed enforcement on Wilson Street West in Hamilton when she recorded a Jeep traveling 126 km/h in a 70 km/h zone. The officer activated her emergency lighting and attempted to initiate a traffic stop. The 25-year-old female driver of the Jeep, who had prior charges from approximately one year earlier for dangerous driving causing bodily harm, did not comply with the attempted traffic stop and instead accelerated. For safety reasons, the pursuit was discontinued. A short time later, the Jeep left the roadway and collided with a tree at Alberton Road South near Book Road West. The driver was transported to hospital and diagnosed with multisystem blunt trauma, including multiple fractures, partial foot amputations, and an open fracture of the lower right leg.  

Based on the SIU’s preliminary inquiries, including a review of video footage that captured the incident in part, Deputy Director O’Brien was satisfied the investigation should be discontinued. It was readily apparent that the officer did nothing that could conceivably attract criminal liability in connection with the injuries of the woman. There being patently nothing to investigate as far as the potential criminal liability of the police is concerned, the file has been closed.  

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
