SIU Terminates Investigation into Man’s Reported Elbow Fracture in Toronto Arrest

The Deputy Director of the Special Investigations Unit, Stacey O’Brien, has terminated an investigation into a reported fractured left elbow suffered by a 36-year-old man during his arrest in Toronto.
On August 17, 2025, the Toronto Police Service notified the SIU that a man they had arrested earlier that day was diagnosed with a serious injury. Preliminary information suggests the man was arrested in the area of Bloor Street East and Mount Pleasant Road after a caller indicated they saw a man kick a door to gain entry to the underground parking garage in the residential building, where the man was attempting to steal bicycles and gain access to vehicles. The man attempted to flee on a bike. Police pursued him and upon taking hold of the clothing at his waist from behind, he lost control and fell. He was taken to hospital and reportedly diagnosed with the serious injury. Efforts by the SIU to speak with the man have been unsuccessful. He declined to provide an interview and did not consent to the release of his medical records. In the absence of a statement, and no evidence of serious injury being identified within the mandate of the SIU, the unit was without jurisdiction to investigate the incident. Every consideration will be given to re-opening the file if the man decides to come forward in the future.
The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must
- consider whether the official has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
- publicly report the results of its investigations
