SIU Terminates Investigation into Man’s Reported Injury After Toronto Arrest

The Deputy Director of the Special Investigations Unit, Stacey O’Brien, has terminated an investigation into a reported fracture suffered by a 59-year-old man in May. The man was arrested the night of May 18, 2026, while Toronto Police Service (TPS) officers were conducting a break-and-enter investigation in the area of Dundas Street East and Jarvis Street. 

During that time officers observed the man, who was wanted on numerous outstanding warrants. At the time of the arrest, both of the man’s arms appeared to be injured and in casts. During his arrest the man was noncompliant and taken to the ground. A number of strikes were delivered to gain control of him and apply handcuffs. The man was transported to 51 Division, where he complained that his pre-existing arm injury had been aggravated by officers during his arrest. He was transported to the hospital, where imaging confirmed his right forearm fracture was a pre-existing injury and identified no new injury, worsening alignment, or evidence of further injury resulting from the interaction with police. Witness evidence, video footage, and medical records established that the man’s arm injury pre-dated the police interaction. On this record, it was apparent no TPS officer was responsible for his injury.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
