SIU Discontinues Toronto Investigation

The Interim Director of the Special Investigations Unit, Joseph Martino, has terminated an investigation into the arrest of a 42-year-old man earlier this month in Toronto.
In the early morning hours of September 5, 2019, Toronto Police Service officers observed the man in the area of Pearson Avenue and Sorauren Avenue. The man fled, but a short distance away, he tripped and fell. The man was arrested and subsequently transported to hospital where he was diagnosed with a fractured right hand.
Interim Director Martino said, “As it is apparent on the SIU’s preliminary inquiries – which included a review of medical records – that his injury pre-dated his arrest and had nothing to do with police officers, the SIU is without jurisdiction to proceed with an investigation. Consequently, the investigation is hereby discontinued, and the file is closed.”
The SIU is an arm’s length agency that investigates reports involving police where there has been death, serious injury or allegations of sexual assault. Under the Police Services Act, the Director of the SIU must
- consider whether an officer has committed a criminal offence in connection with the incident under investigation
- depending on the evidence, lay a criminal charge against the officer if appropriate or close the file without any charges being laid
- report the results of any investigations to the Attorney General.
