Officers Acted Lawfully in Arrest of Man at Toronto Hotel; No Charges to Issue

Mississauga, ON (8 May, 2020) ---
In the early morning of November 5, 2019, Toronto Police Service officers attended a hotel in Toronto after receiving information about an assault. Following a struggle between two police officers and a 52-year-old man, the man was arrested. He was taken to hospital for treatment of serious injuries. The Director of the Special Investigations Unit, Joseph Martino, has determined there are no reasonable grounds to believe that either officer committed a criminal offence in connection with the man’s arrest and injuries.

The SIU is a civilian agency that investigates reports involving police where there has been death, serious injury or an allegation of sexual assault. Under the Police Services Act, the Director of the SIU must

  • consider whether an officer has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, lay a criminal charge against the officer if appropriate or close the file without any charges being laid
  • report the results of investigations to the Attorney General.
