No Basis for Proceeding with Charges in North Bay Arrest Case

Mississauga, ON (30 July, 2020) ---
On March 30, 2020, OPP officers convened in North Bay with a view to arresting a 38-year-old man on drug possession and trafficking charges. It was their plan to arrest the man once he stepped out of the house. Shortly before 6:30 p.m., the man, in the company of a female, exited the home on Percy Street and travelled on foot eastward on the north sidewalk of Cassells Street. The officers approached, and following a brief struggle on the ground, the man was handcuffed and taken into custody by the officers. The following morning, the man was taken to hospital and diagnosed with a broken clavicle. The Director of the Special Investigations Unit, Joseph Martino, has determined there is no basis for proceeding with charges in this case and the file is closed.

The SIU is an arm’s length agency that investigates reports involving police where there has been death, serious injury or allegations of sexual assault. Under the Police Services Act, the Director of the SIU must

  • consider whether an officer has committed a criminal offence  in connection with the incident under investigation
  • depending on the evidence, lay a criminal charge against the officer if appropriate or close the file without any charges being laid
  • report the results of any investigations to the Attorney General.
