SIU Investigating Man’s Fall from Gardiner Expressway in Toronto

Mississauga, ON (15 October, 2025) ---
The Special Investigations Unit found no reasonable grounds to believe a Toronto Police Service officer committed a criminal offence in connection with the broken legs and broken spine suffered by a 21-year-old man in a fall while fleeing arrest. On June 16, 2025, police received reports of two carjackings, one involving a Rolls Royce stolen by three men. The men fled the area in the Rolls Royce and a BMW X5 until coming to a stop on the Gardiner in a police blockade. The BMW driver fled on foot and officers chased him.

Director Joseph Martino was satisfied that the officers comported themselves with due care and regard for public safety as they ran after the man on the highway. They had cause to pursue him aggressively given the violent crimes that had just been committed, and there was a real risk that he would escape if they did not chase him across the highway. At the same time, they shouted at the man to stop and gave him ample opportunity to desist before he climbed over the barrier and fell from height.

The SIU is an independent government agency that investigates the conduct of officials (municipal, regional and provincial police officers, police officers with the Nishnawbe Aski Police Service, special constables with the Niagara Parks Commission and peace officers with the Legislative Protective Service) that may have resulted in death, serious injury, sexual assault and/or the discharge of a firearm at a person. All investigations are conducted by SIU investigators who are civilians. Under the Special Investigations Unit Act, the Director of the SIU must

  • consider whether the official has committed a criminal offence in connection with the incident under investigation
  • depending on the evidence, cause a criminal charge to be laid against the official where grounds exist for doing so, or close the file without any charges being laid
  • publicly report the results of its investigations
